1. Our Services. We provide a service for webmasters
to send us their error traffic in return for traffic from other
sites in our network. The hits they receive will be coming from
other sites’ error traffic to the domain they specified,
could be multiple domains.
2. Age Requirement. You must
be at least sixteen (16) years of age to use the Site, Services.
You represent, warrant and covenant that you meet this age
requirement.
3. Access. You must have
access to the World Wide Web in order to use our Site, Services.
It is your responsibility to select, obtain and pay for any
equipment (e.g., computer or modem) and services (e.g., phone
line or DSL) necessary for such access.
4. Registration. If you accept
the Terms, 404 Traffic Bank will ask you to complete a registration
form in order to establish your membership account.
5. License. Subject to all
of the Terms, 404 Traffic Bank hereby grants you a personal,
non-exclusive, non-transferable license to access & use
the sites services following the guidelines set at http://404trafficbank.com/guidlines.html
6. Restrictions. You agree
not to do any of the following prohibited actions:
No Multiple Accounts
This means absolutley no spreading your domains ( URL to the
system ) over mutiple accounts. This keeps it fair to us,
tryin being able to keep track and help people better. It's
unnecessary please just dont do it. Both accounts will be
suspended when, not if, we find out.
No compromising the system
This means anyone that try's to gain extra credits by doing
anything stupid. We have systems in place to flag accounts
for "funny" behaivor. if you choose to try this,
once we catch you. Your accounts will be banned from our service.
This ban IS permanent.
Choose which traffic type correctly, the first time!
When submitting a URL. Make sure you choose Adult or N.Adult
correctly. We cannot afford to have a PG rated site receive
adult traffic. There is a system in place to catch this. Although
it is hard to catch em all. Just double check which site you
are adding and do it right folks. By default N.Adult is selected,
so it's by pure neglect that it would be wrong.
Own every domain you submit
Yes, you must own the domains the you submit. No exception,
we are not here to sort out people's "arrangements".
So that comes down to this. If you have an "arrangement"
with someone to "admin" your web site 404 Traffic
Bank is not reponsible for that.
Illegal content/natured web sites not allowed
This is for quite obvious reasons. If you are stupid enough
to not read this then you deserve being reported as I will
do. You've been warned!
9. Your Account is Your Responsibility.
You are solely responsible and entirely liable for all activities
conducted through your account / email account, even if your
account has been compromised through no fault of your own.
404 Traffic Bank encourages you to maintain the confidentiality
of your password, and reminds you that you do not have a license
to let others use your account. You agree to notify 404 Traffic
Bank immediately in the event your password is lost, stolen,
disclosed or compromised. It is not 404 Traffic Bank’s
policy to ask for your password online, and 404 Traffic Bank
suggests that you never respond to an on-line request for
your password.
10. Privacy. You understand
that you have no expectation of privacy with respect to your
use of the Site, Services and that all communications made
by or received from you may be monitored, preserved and disclosed
by 404 Traffic Bank representatives. You acknowledge and agree
that 404 Traffic Bank will report to law enforcement authorities
any actions which may be considered illegal, as well as any
reports it receives of such conduct. 404 Traffic Bank will
cooperate fully with law enforcement agencies in any investigation
of alleged illegal activity. Specifically, 404 Traffic Bank
may disclose information about you or your Participatory Content
or Public Content if 404 Traffic Bank has the good faith belief
that such disclosure is reasonably necessary to: (a) comply
with legal process; (b) enforce the Terms; (c) respond to
claims that any your Participatory Content and/or Public Content
violates the rights of a third party; or (d) protect the rights,
property or safety of 404 Traffic Bank its members or the
public
11. Charges for Service.
404 Traffic Bank will skim 2% of all the networks incoming
traffic. Skim meaning “take”, sending it to 404
Traffic Bank’s sites of choice.
12. International Use. Recognizing
the global nature of the Internet, you agree to comply with
all local rules regarding online conduct and acceptable content.
Specifically, you agree to comply with all applicable laws
regarding the transmission of technical data exported from
the United States & Canada or the country in which you
reside.
14. Disclaimer of Warranty. TO THE MAXIMUM
EXTENT PERMITTED BY LAW, 404 Traffic Bank, ITS AFFILIATES,
LICENSORS AND SUBCONTRACTORS DISCLAIM ALL WARRANTIES, EXPRESS,
IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 404
Traffic Bank PROVIDES THE SITE, SERVICES (AND ANY RELATED
SOFTWARE OR HARDWARE USED OR PROVIDED BY 404 Traffic Bank
IN CONNECTION THEREWITH OR ANY CONTENT INCLUDED THEREIN) "AS
IS" AND ON AN "AS AVAILABLE" BASIS, AND MAKES
NO WARRANTY OF PERFORMANCE OR QUALITY OR THAT THE SITE, SERVICES
WILL BE ERROR-FREE OR UNINTERRUPTED. SOME JURISDICTIONS DO
NOT PERMIT THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION
MAY NOT APPLY TO YOU.
15. Termination. Either you or 404 Traffic
Bank may terminate your account and this agreement upon notice
at any time without further obligation to the other. Further,
404 Traffic Bank reserves the right to terminate the Site,
Services, or any part thereof, at any time without notice
and without further obligation to you. IN NO EVENT SHALL YOU
BE ENTITLED TO A REFUND OF ANY FEES/CREDITS OR PRORATION THEREOF.
UPON TERMINATION OF THIS AGREEMENT, YOUR ACCESS PRIVILEGES
TO THE SITE, SERVICES WILL TERMINATED AND YOU WILL FORFEIT
ANY UNUSED ACCESS TIME THAT YOU “BANKED” OR RECEIVED
PRIOR TO TERMINATION. A member whose account 404 Traffic Bank
has terminated may not access the Site, Services in any manner
or for any reason without 404 Traffic Bank express, prior,
written permission.
16. Amendment. 404 Traffic
Bank may amend the Terms in its sole discretion at any time
by posting revised Terms on the Site, and you agree to regularly
review the Terms. If any such revision is unacceptable to
you, you may terminate your account and this agreement . Your
continued access and use of the Site, Services seven (7) days
after posting of the revised Terms shall constitute your acceptance
of the same. Except as expressly set forth herein, the Terms
may not otherwise be modified or amended.
17. Reservation of Rights.
404 Traffic Bank hereby reserves any rights not expressly
granted herein.
